ROAVIX RENTALS – Rental Agreement Terms

Traffic Violations, Tolls, and Fees The Renter is solely responsible for all tolls, parking tickets, traffic violations, camera tickets, red-light camera violations, speed camera violations, towing charges, impound fees, administrative fees, and any other fines or penalties incurred during the rental period. The Renter agrees to pay all such charges within forty-eight (48) hours of receiving notice from Roavix Rentals. If the Renter fails to do so, Roavix Rentals may charge the payment method on file for the full amount, plus any processing or administrative fees permitted by law. The Renter shall also reimburse Roavix Rentals for any collection costs, court costs, reasonable attorney’s fees, and other expenses incurred in recovering unpaid amounts. Accidents and Liability The Renter agrees to operate the vehicle safely and in compliance with all federal, state, and local laws. If the Renter is involved in an accident while operating the rental vehicle and is determined to be at fault, the Renter agrees to be financially responsible, to the extent permitted by law, for all damages, losses, claims, deductibles, uninsured losses, and expenses arising from the accident, including: * Damage to the rental vehicle. * Damage to any other vehicle involved. * Damage to any building, fence, sign, utility, or other real or personal property. * Bodily injury or death of any person. * Towing, storage, impound, and recovery expenses. * Loss of use of the rental vehicle while it is being repaired or replaced. * Any insurance deductibles or amounts not covered by insurance. The Renter shall immediately notify Roavix Rentals of any accident and fully cooperate with insurance companies, law enforcement, and any investigation. Indemnification To the fullest extent permitted by law, the Renter agrees to defend, indemnify, and hold harmless Roavix Rentals, JLani Holdings LLC, its owners, officers, employees, and agents from any and all claims, lawsuits, judgments, damages, liabilities, losses, costs, and expenses arising out of or related to the Renter’s possession, operation, or use of the rental vehicle during the rental period. Graves Amendment The parties acknowledge that Roavix Rentals is engaged in the business of renting motor vehicles. Pursuant to the Graves Amendment (49 U.S.C. § 30106), Roavix Rentals shall not be held vicariously liable solely by reason of ownership of the rental vehicle for harm arising out of the use, operation, or possession of the vehicle during the rental period, except as otherwise required by applicable law. The Renter agrees that, to the fullest extent permitted by law, the Renter shall remain responsible for all damages, claims, liabilities, and expenses arising from the Renter’s operation or use of the rental vehicle. Payment Responsibility The Renter authorizes Roavix Rentals to charge any payment method on file for: * Rental charges. * Vehicle damages. * Insurance deductibles. * Tolls. * Traffic violations. * Administrative fees. * Cleaning fees. * Smoking fees. * Late return fees. * Towing and storage charges. * Collection costs and any other amounts owed under this Agreement. Failure to pay any amount due under this Agreement may result in legal action, collection proceedings, and reporting to appropriate agencies as permitted by law.
